IN 2020 WE CELEBRATED THE 100TH ANNIVERSARY OF THE 19TH AMENDMENT GUARANTEEING WOMEN’S RIGHT TO VOTE, AND STILL WOMEN ARE NOT INCLUDED IN THE U.S. CONSTITUTION. FLORIDA, LET’S RATIFY THE EQUAL RIGHTS AMENDMENT.

Through ratification of the Equal Rights Amendment Florida’s Senators and Representatives honor and affirm our State Constitution’s guarantee of equal rights to all men and women. The passage of HCR 239 by Florida’s State Legislators would enshrine equal rights in the Constitution of the United States and ensure our lawmakers’ place in the history of our nation.

Equal rights for men and women is already in the DNA of our State Constitution.
Florida State Constitution, Article 1 Declaration of Rights, Section 2 Basic Rights:

“All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness, to be rewarded for industry, and to acquire, possess and protect property. No person shall be deprived of any right because of race, religion, national origin, or physical disability.”

The Equal Rights Amendment is not partisan. In recent years, the United States has experienced a groundswell of bipartisan support for the Equal Rights Amendment.

In 2016 the ERA Coalition commissioned a poll and eighty percent of those polled mistakenly believed that women and men were already guaranteed equal rights under the U.S. Constitution.

Ninety-four percent of those polled said they would support an amendment to the U.S. Constitution that guarantees equal rights for women. This support was expressed by both women and men regardless of political party.

Women are not included in the U.S. Constitution under the 14th Amendment. This Amendment was in place over 50 years before women even had the right to vote. And before his passing, Supreme Court Justice Scalia made clear that the 14th Amendment does not speak to gender.

Laws protecting women are not enough as they can be rolled back by a simple act of Congress. As example, Congress allowed the Violence Against Women Act to expire in 2018. A constitutional amendment provides a needed layer of safety and protection to women. Update: March 17, 2021, the House approved with bipartisan support a reauthorization of the VAWA 244-172, but Senate hurdles remain.
